This law sets out the fees that lawyers may charge for specific legal services \u2014 both in and out of court \u2014 unless the parties agree otherwise in a fee agreement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Fee Calculation Based on the &#8220;Gegenstandswert \/ Streitwert&#8221; (Value in Dispute)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For most out-of-court legal services \u2014 such as drafting formal demand letters, negotiating settlements, or advising clients on enforceable claims \u2014 the legal fees are calculated according to the <strong>monetary value of the issue<\/strong>, called the <strong>Gegenstandswert<\/strong> (value in dispute). The higher the value of the matter, the higher the applicable fees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let\u2019s take a simple example: if a client seeks to recover \u20ac10,000 in unpaid invoices, the fee is based on \u20ac10,000. The <strong>base fee for out-of-court services (1.3 Gesch\u00e4ftsgeb\u00fchr)<\/strong> is then determined from an official fee table tied to this amount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This system is intended to ensure a fair, predictable structure for legal costs based on the scope and legal significance of the case.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Default Values in Family Law and Non-Monetary Disputes (&#8220;Auffangstreitwerte&#8221;)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In cases where there is <strong>no specific financial claim<\/strong>, such as <strong>custody, visitation, or declaratory matters<\/strong>, the law provides for <strong>standard dispute values<\/strong>, also called <strong>\u201cAuffangstreitwerte\u201d<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Divorce proceedings<\/strong>: Calculated as <strong>three times the net monthly income<\/strong> of both spouses combined.<\/li>\n\n\n\n<li><strong>Custody or visitation disputes<\/strong>: Typically assigned a standard Streitwert of <strong>\u20ac4,000<\/strong>.<\/li>\n\n\n\n<li><strong>Non-monetary civil law disputes<\/strong>: Often assigned values ranging from <strong>\u20ac1,000 to \u20ac5,000<\/strong>, depending on complexity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These default values serve to standardize legal fees and ensure consistency across similar cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can easily check the fees for out-of-court representation by using this tool:<br><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><a href=\"https:\/\/www.juris.de\/jportal\/nav\/services\/prozesskostenrechner\/index.jsp\" target=\"_blank\" rel=\"noreferrer noopener\">h<\/a><a href=\"https:\/\/anwaltsblatt.anwaltverein.de\/de\/apps\/prozesskostenrechner\" target=\"_blank\" rel=\"noreferrer noopener\">ttps:\/\/anwaltsblatt.anwaltverein.de\/de\/apps\/prozesskostenrechner<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> <br><br>Just type in the in the box &#8220;Streitwert&#8221; ( #1 ) the amount in dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">and make sure the box &#8220;Au\u00dfergerichtliche Vertretung&#8221; is checked (#2),<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">and you\u00b4ll see the fees (#3)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">like this:<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"719\" src=\"https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/out-of-court-fees-1024x719.png\" alt=\"\" class=\"wp-image-304\" srcset=\"https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/out-of-court-fees-1024x719.png 1024w, https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/out-of-court-fees-300x211.png 300w, https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/out-of-court-fees-768x539.png 768w, https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/out-of-court-fees.png 1108w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As you can see in the example above, given an amount in dispute of 4.000 Euro, the fees for the out of court representation (&#8220;Summe au\u00dfergerichtliche Kosten&#8221;) are 453,87 Euro.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Additional Fees for Settlements<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If an attorney&#8217;s out-of-court work results in a <strong>formal settlement<\/strong> (i.e. a binding agreement between the parties), the RVG allows for an additional fee \u2014 the <strong>\u201cEinigungsgeb\u00fchr\u201d<\/strong> or settlement fee. This is usually <strong>1.5 times<\/strong> the base rate and is meant to compensate for the additional time, skill, and effort required to reach a negotiated solution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even if no lawsuit is filed, the mere fact that the lawyer helps both sides reach a settlement agreement can increase the total fee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the example above, to figure out the fees for settlement, just check the box: &#8220;Einigungsgeb\u00fchr Nr. 1000 VV RVG&#8221; (# 4) as indicated here:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"640\" src=\"https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/settlment-fee-1024x640.png\" alt=\"\" class=\"wp-image-305\" srcset=\"https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/settlment-fee-1024x640.png 1024w, https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/settlment-fee-300x188.png 300w, https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/settlment-fee-768x480.png 768w, https:\/\/attorney-stawrew.eu\/wp-content\/uploads\/2025\/04\/settlment-fee.png 1136w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As you can see, if the case is closed by an out-of-court settlement, the legal fees (&#8220;Summe au\u00dfergerichtliche Kosten&#8221;) are now 950,10 Euro &#8211; or roughly twice as much.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Typical Hourly Rates in German Law Firms<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In some cases, particularly for <strong>business clients or complex individual matters<\/strong>, German lawyers may offer their services based on <strong>hourly billing<\/strong>, provided this is agreed upon in advance and in writing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Typical hourly rates (as of 2025) are as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Small \/ regional cases<\/strong>: \u20ac180\u2013\u20ac280 per hour<\/li>\n\n\n\n<li><strong>Cases requiring specialist knowledge and experience<\/strong>: \u20ac250\u2013\u20ac400 per hour<\/li>\n\n\n\n<li><strong>Top-tier international or high-profile cases<\/strong>: \u20ac400\u2013\u20ac700+ per hour<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At our firm, we believe in fair and transparent pricing. VAT and Services Rendered to Foreign Businesses<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Under German VAT law, if the legal service is provided to a <strong>business client located in another EU member state<\/strong>, and that client has a <strong>valid EU VAT ID<\/strong>, then <strong>no German VAT will be charged<\/strong> on the invoice. Instead, the reverse charge mechanism applies, and the client is responsible for declaring and paying the VAT in their home country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This applies, for instance, when a German lawyer represents a Romanian or Dutch company in collecting debt or handling civil disputes in Germany.
